The application of ADR principles in the operation of today's Health Care Industry can be very valuable using traditional mediation and arbitration processes and creative facilitation techniques.  Litigation Alternatives, Inc. with the insight and assistance of House Neutral, John Perlstein, has developed a Health Care Alternative Dispute Resolution program that not only includes mediation and arbitration of traditional disputes, but also addresses the key dynamics inherent in the multi-layered and complex set of relationships that is today's health care system.

The complexities of the health care system have necessarily created an important web of relationships for those businesses and individuals who participate in that system.  The efficient and cost effective maintenance of these relationships {including hospitals, physicians, health insurers, government and businesses providing health care coverage to their employees to name a few} is critical to the effective delivery of health care services to patients.  Accordingly, the fair and efficient resolution of disputes that impede these relationships is vital to the interests of all involved.

Mr. Perlstein and Litigation Alternatives, Inc.'s vision of services that are calculated to assist the industry include:

  • Mediation and arbitration of health care, coverage payment and service delivery/treatment disputes; and
  • Consulting assistance in the resolution of key contract negotiations involving the intertwining contractual relationships between hospitals, physicians, dentists, mental health professionals, nurses, chiropractors, physical therapists, other health care professionals, managed care organizations, health insurance companies, retail pharmacies and pharmaceutical manufacturers.

By providing targeted mediation, consultation and facilitation services it is our goal to help participants expedite  dispute resolution and save costs in areas including reimbursement, service delivery and contract negotiations.  We will show how and where the addition of a neutral mediator/consultant can create an environment that will enhance the ability of the parties to resolve their differences.

Our program is predicated on the premise that critical value is provided not only by assisting in the negotiation and interpretation of health care contracts per se, but also in retaining and maintaining the "quality" of the relationships represented by those contracts - despite the fact that interests can be adversarial at times.  This can be accomplished by the addition of a mediator/consultant to the mix. 

Using basic ADR principles, our consultant will confidentially meet with the parties and in so doing, endeavor to create an agenda that will assist them to develop a critical path to settlement of their dispute/s.  Once a plan of action can be determined, meetings calculated to resolve problems can be scheduled and commenced.

COSTS

Traditional mediations and arbitrations will charged as indicated on our Fee Schedule.

The hourly fees for Mediator/Consultants will be negotiated at the outset of services and will be in the $325.00. to $400.00 per hour range, depending on the consultant.  Minimum charges will be 1/2 a day {3 Hours} and will include document review.
